Summary of Case Law in terms of the promotion of access to information act – The South African Experience:

The right of access to information is enshrined as a fundamental right in the South African Constitution. In terms section 32 (1) of the Bill of Rights,

(a) 'everyone has the right of access to any information held by the state and
(b) any information that is held by another person and that is required for the exercise or protection of any rights.'
