After the initial release on the 26 April 2010, ODAC acting on behalf of the South African History Archive (SAHA), in court contested the outstanding documents which included Annual Reports of the Sale of Arms by the NCACC.
The matter was settled with the release of the following:
The names of persons registered with the Secretariat in Accordance with Section 13 of the Act, showing whether that person is registered to:
- Sell arms to the public within South Africa ;
- Sell arms to government agencies within South Africa;
- Export or re-export other arms to South Africa;
- Manufacture arms or
- Otherwise to market, import, convey trade in or broke arms
Still outstanding is the following:
Records in accordance with section 15(4)(a) of the Act of every permit issued to Armscor, for each year from (and including) 2003 – 2007 providing full details of the quantity, type and value of each type of arms included in the permit; The names of persons to whom the permit was issued.
The NCACC committee will convene on the 27 May 2010 to discuss whether to give the documents censored or uncensored as the release might ‘Jeopardise the Security of the Country”
PAIA gives effect to the Constitutional right of access to any information that is held by the state and any information that is held by another person and that is required for the exercise or protection of any rights.
