NEW!! Whistleblowing Provision in the New Companies Act 71 of 2008:

The Whistleblowing Provision under the New Companies Act supplements the provisions of the Protected Disclosures Act. Under the new Companies Act, the significant sub section is S 7 which provides that public and State owned companies must establish and maintain a system to receive disclosures confidentially and act on them and rountinely publicises the availability of that system to employees.

Protected Disclosures Act, 2000:

To make provision for procedures in terms of which employees in both the private and the public sector may disclose information regarding unlawful or irregular conduct by their employers or other employees in the employ of their employers; to provide for the protection of employees who make a disclosure which is protected in terms of this Act; and to provide for matters connected therewith.
